Character and Fitness Matters

Character and fitness are a term that most laypeople, or those thinking of going to law school, know little about. However, if you are thinking of going to law school, or a prospective, current, or recently graduated law student, stop what you are doing now and listen. This is especially true if you have anything in your background, such as not meeting financial responsibilities, arrests, convictions, addiction issues, dealings with law enforcement, academic misconduct, and other similar items.
Every year many students rush through his or her law school application and wonder why the application asks about every little deal of police interaction, lawsuits you’ve been involved with, and debts you haven’t paid. The schools are not asking that to be nosy. They ask these questions because when you graduate law school if you take the bar, those questions and more will be asked in your bar application to determine whether you have the requisite character and fitness to be licensed to practice law in the jurisdiction you’re applying. Those bar examiners will have your law school application and will compare it with the bar application.
Committees on Character and fitness are concerned with your present character and general fitness to practice law. How you think about your past mistakes, how you address, fix, confront, and rehabilitate are essential to how quickly you will receive your license even after you graduate law school and pass the bar. TRANSPORTATION SECURITY ADMINISTRATION (TSA) LETTERS OF INVESTIGATION (LOI) AND NOTICES OF VIOLATION (NOV)
Believe it or not, if you are suspected of violating even minor rules, the TSA has the authority to start an investigation that often results in monetary penalties, and in some cases, referred for prosecution. If you receive a letter of investigation, or worse, an NOV, it’s prudent to have an attorney to handle the response to the LOI and an NOV. It will save you money in most instances, and a headache.
